Swipy Terms of Use

This is an English translation of the Russian Пользовательское соглашение Swipy. If the versions differ, the Russian version prevails.
1. Rightholder and terms of use
Swipy's rightholder: Vladimir Vladimirovich Bredikhin, a self-employed individual paying the Russian professional income tax, taxpayer ID (INN) 463228181969. Support and legal requests: compressify@yandex.ru. Swipy belongs to the Compressify brand and uses its compression algorithms.
By using Swipy, you accept these terms. You receive a free, non-exclusive licence to install and use the app on your devices in any country for the term of the exclusive right. The current version has no paid features, subscriptions, ads or mandatory sign-up.
The rights to your photos and videos remain with you and their lawful rightholders. Using Swipy does not transfer any rights to these materials to the app's rightholder.
2. What the app does
Swipy helps you browse photos and videos, choose albums and filters, find similar shots, build a deletion queue and create compressed copies of photos. Search and compression run on your device. The daily pick, statistics and optional local reminders help you sort your gallery regularly.
Working with files requires Android permissions. Available features depend on the system version, granted access, file format and free storage. You may only handle materials you have a lawful right to use.
3. Choosing and deleting
A swipe puts a file in the queue rather than deleting it right away. Until you confirm, you can review the queue and change your mind.
Swipy does not delete files without your confirmation. Moving to Trash, deleting and emptying Trash are carried out only through an Android system request: a file is deleted only if you confirm that request. On some devices the request lets you look at the files being deleted once more.
Swipy does not work with files in the background while the app is closed. Queued compression runs while the app is open and creates new files without changing the originals. Local reminders may arrive while the app is closed, but they do not access files.
By default, Swipy moves files to the system Trash. You can choose permanent deletion in the settings. Recovery from Trash is governed by the system; Swipy does not recover permanently deleted files. Deletion may spread to your cloud gallery and other devices through sync that you have turned on.
Before confirming, check the files and back up important materials. Statistics count deletions confirmed by the system; storage may actually be freed later, for example after Trash is emptied.
4. Compression
Compression creates a separate copy and may change the photo's quality, format and metadata. Space savings depend on the original file and the chosen settings; the same result is not guaranteed for every photo. The original is not overwritten; it joins the deletion queue only after the new copy has been verified as saved.
The automatic check of the saved copy does not replace your own assessment of its quality. Compare the result with the original before confirming deletion. Compression does not guarantee that personal information is removed from metadata.
5. Files, backups and liability
Swipy works on your device: browsing, similar photo search, compression and the deletion queue are processed locally, and files are not sent to the rightholder. The rightholder therefore cannot see your gallery and cannot restore deleted or changed files.
You make the decisions about your files: what to keep, which compressed copies to save and what to delete after confirmation. Before confirming, check the queue and compressed copies. Before deleting or compressing, you make your own backups of important materials: this is the only reliable way to get a file back after permanent deletion.
The rightholder is not liable for deleting or changing files that you selected and confirmed, if Swipy carried out exactly that action, or for failures of Android, the cloud gallery, memory cards, devices and other software that are beyond the rightholder's control.
The rightholder is liable for errors in Swipy itself in accordance with Russian law. If you notice that the app is working incorrectly, stop using that feature and report the problem to support. When the consequences of an error are assessed, the user's own actions are also taken into account, including reviewing the queue and having a backup.
These terms do not exclude liability that cannot be excluded or limited by law, in particular for intentional breach, and do not limit the user's mandatory rights.
6. Support and ending use
You can report a problem to compressify@yandex.ru, stating the app version, Android version and what happened. Information about data processing is in the privacy policy.
Android, the cloud gallery and RuStore are also governed by the rules of those services.
Third-party components and their licence terms are listed in the app's licences section. These terms do not override those licences.
You can stop using and uninstall Swipy at any time. Uninstalling the app does not delete files from your gallery. A new version of these terms with the date of change may be published for updated versions of the app; it does not cancel rights and obligations that have already arisen. Russian law applies, without depriving you of the mandatory protections of the law of your country of residence where that law applies. Requests and disputes are handled in the established manner.
